apakah quran mengizinkan menikah dengan wanita yang belum menstruasi??? jawabannya adalah YES!! .buktinya quran mengatur masa iddah( masa menunggu seorang istri yang dicerai suaminya untuk dapat menikah lagi)., bagi perempuan yang belum menstruasi berdasarkan tafsir klasik on line yang saya temukan:

And those who are pregnant, their term, the conclusion of their prescribed [waiting] period if divorced or if their spouses be dead, shall be when they deliver. And what is the waiting period of the pregnant woman?’ And so Allah, exalted is He, revealed this verse”. Abu Ishaq al-Muqri’ informed us> Muhammad ibn ‘Abd Allah ibn Hamdun> Makki ibn ‘Abdan> Abu’l-Azhar> Asbat ibn Muhammad> Mutarrif> Abu ‘Uthman ‘Amr ibn Salim who said: “When the waiting period for divorced and widowed women was mentioned in Surah al-Baqarah, Ubayy ibn Ka‘b said: ‘O Messenger of Allah, some women of Medina are saying: there are other women who have not been mentioned!’ He asked him: ‘And who are they?’ He said: ‘Those who are too young [such that they have not started menstruating yet], those who are too old [whose menstruation has stopped] and those who are pregnant’. And so this verse (And for such of your women as despair of menstruation…) was revealed”.

karenah darih segih kesehatan membuktikan bahwa ayat tersebut medahului sains.
perempuan kebanyakan mengalamih menstruasih padah usiah antarah duah belas dan tigah belas tahun,tetapih selaluh terdapat perempuan yang mengalaminya pada usia lebih awal, kira-kira sembilan-sebelas tahun, dan bahkan mungkin lebih dinih. Di lain pihak beberapah perempuan mungkin belum mengalamih menstruasih sampaih usia 15 tahun atau 16 tahun atau 18 tahun. Ini semua bergantung pada produksi dan pelepasan hormon.
Menstruasih dapat tertundah karenah beberapah sebab: aktivitas fisik yang berat, berat badan kurang, gangguan medis, atau karenah faktor keturunan. Apakah mungkin tidak pernah mengalami haid? Perempuan yang tidak pernah mengalamih periodeh menstruasih hampir selaluh lahir dengan gangguan genetik, abnormal,atau gangguan yang diperoleh sebagaih hasil darih masalah keluargah atauh kerusakan dalam gen merekah.
sekalih lagih...terserah anda jika menafsirkan ayat tersebut sebagai ijin ber-pedofil.
Karenah memang TIDAK ADA seorang muslim pun yang menggunakan ayat tersebut sebagai dasar pembenaran perilakuh pedofilia kecualih orang-orang sepertih andah.

وبين الفوزان أنه ليس في الشريعة ما يُحدد السن الذي تُزوج فيه الفتاة؛ بل في الشريعة ما يدل على خلاف ذلك، مستدلا بقوله تعالى في عدة المطلقة: "واللائي يئسن من المحيض من نسائكم فعدتهن ثلاثة أشهر واللائي لم يحضن"؛ أي الصغيرات اللاتي لم يبلغن سن الحيض فعدتهن ثلاثة أشهر، مثل اليائسات من الحيض، فهذا دليل من القرآن على أن الصغيرة تُزوج وتطلق وتلزمها العدة.
وأضاف "دلت السنة على ذلك، فقد تزوج النبي -صلى الله عليه وسلم- عائشة رضي الله عنها وهي بنت ست سنين. ودخل بها وهي بنت تسع سنين، فهذا دليل من السنة على هذه المسألة، وقد أجمع العلماء على جواز ذلك".
وأشار إلى أن الإمام البخاري قال في صحيحه: باب إنكاح الرجل ولده الصغار. لقوله تعالى: "واللائي لم يحضن"، فجعل عدتها ثلاثة أشهر قبل البلوغ. حدثنا محمد بن يوسف حدثنا سفيان عن هشام عن أبيه عن عائشة رضي الله عنها: أن النبي صلى الله عليه وسلم تزوجها وهي بنت ست سنين، وأدخلت عليه وهي بنت تسع، ومكثت عنده تسعا. قال الحافظ ابن حجر رحمه الله في الفتح: قوله: لقول الله تعالى: "واللائي لم يحضن"، فجعل عدتها ثلاثة أشهر قبل البلوغ، أي فدل على أن نكاحها قبل البلوغ جائز، وهو استنباط حسن، لكن ليس في الآية تخصيص ذلك بالوالد ولا بالبكر".
ونقل عضو هيئة كبار العلماء قول ابن بطال في شرحه لصحيح البخاري في صفحة 172 - 173 على باب تزويج الصغار من الكبار: أجمع العلماء على أنه يجوز للآباء تزويج الصغار من بناتهم وإن كن في المهد؛ إلا أنه لا يجوز لأزواجهن البناء بهن إلا إذا صلحن للوطء، واحتملن الرجال، وأحوالهن تختلف في ذلك على قدر خلقهن وطاقتهن. وكانت عائشة رضي الله عنها حين تزوج بها النبي بنت ست سنين وبنى بها بنت تسع.
ونقل الفوزان قول مفتي السعودية الراحل الشيخ عبد العزيز بن باز في مجموع فتاواه ومقالاته الجزء الرابع صفحة 126 لما بلغه أن بعض الدول الإسلامية تريد تحديد سن الزواج بأن لا يقل عمر الفتى عن ثمانية عشر عاما وعمر الفتاة عن ستة عشر عاما. قال: فلما كان ذلك يخالف ما شرعه الله جل وعلا أحببت التنبيه لبيان الحق. فالسن في الزواج لم يُقيد بحد معين لا في البكر ولا في الصغير. والكتاب والسنة يدلان على ذلك. لأن فيهما الحث على الزواج والترغيب فيه من دون تقييد بسن معينة.
وخلص إلى القول: إنه "يجب على هؤلاء الذين ينادون بتحديد سن الزواج أن يتقوا الله ولا يخالفوا شرعه، أو يشرعوا شيئا لم يأذن به الله، فالحكم لله عز وجل، والتشريع حق له سبحانه لا يشاركه فيه غيره. ومن ذلك أحكام الزواج".

(Raymond Ibrahim) — Muslim “child-marriage” — euphemism for pedophilia — is making headlines again, at least in Arabic media: Dr. Salih bin Fawzan, a prominent cleric and member of Saudi Arabia’s highest religious council, just issued a fatwa asserting that there is no minimum age for marriage, and that girls can be married “even if they are in the cradle.”
Appearing in Saudi papers on July 13, the fatwa complains that “Uninformed interference with Sharia rulings by the press and journalists is on the increase, posing dire consequences to society, including their interference with the question of marriage to small girls who have not reached maturity, and their demand that a minimum age be set for girls to marry.”
Fawzan insists that nowhere does Sharia set an age limit for marrying girls: like countless Muslim scholars before him, he relies on Koran 65:4, which discusses marriage to females who have not yet begun menstruating (i.e., are prepubescent) and the fact that Muhammad, Islam’s role model, married Aisha when she was 6-years-old, “consummating” the marriage — or, in modern parlance, raping her — when she was 9. . . .
Fawzan concludes his fatwa with a warning: “It behooves those who call for setting a minimum age for marriage to fear Allah and not contradict his Sharia, or try to legislate things Allah did not permit. For laws are Allah’s province; and legislation is his excusive right, to be shared by none other. And among these are the rules governing marriage.”...................

أكد الشيخ الدكتور صالح بن فوزان الفوزان -عضو هيئة كبار العلماء، عضو اللجنة الدائمة للإفتاء بالسعودية- أن تزويج الفتاة الصغيرة التي لم تصل إلى مرحلة البلوغ من كفء؛ سائغ بإجماع الفقهاء.
وقال الفوزان في فتوى نشرتها الصحف السعودية الأربعاء 13 يوليو/تموز 2011: "كثرت في هذا الوقت تدخلات الصحافة والصحفيين في الأحكام الشرعية من غير علم، وهذا عمل يُخاف من عواقبه على المجتمع، ومن ذلك تدخلهم في مسألة تزويج الصغيرة التي دون البلوغ من كفء يصلح لها، ومطالبتهم بتحديد سن لتزويج الفتاة".
ووصف ذلك بأنه "تدخل في حكم شرعي، مرجعه أهل العلم، وعلى ضوء الكتاب والسنة".
وبين الفوزان أنه ليس في الشريعة ما يُحدد السن الذي تُزوج فيه الفتاة؛ بل في الشريعة ما يدل على خلاف ذلك، مستدلا بقوله تعالى في عدة المطلقة: "واللائي يئسن من المحيض من نسائكم فعدتهن ثلاثة أشهر واللائي لم يحضن"؛ أي الصغيرات اللاتي لم يبلغن سن الحيض فعدتهن ثلاثة أشهر، مثل اليائسات من الحيض، فهذا دليل من القرآن على أن الصغيرة تُزوج وتطلق وتلزمها العدة.
وأضاف "دلت السنة على ذلك، فقد تزوج النبي -صلى الله عليه وسلم- عائشة رضي الله عنها وهي بنت ست سنين. ودخل بها وهي بنت تسع سنين، فهذا دليل من السنة على هذه المسألة، وقد أجمع العلماء على جواز ذلك".
وأشار إلى أن الإمام البخاري قال في صحيحه: باب إنكاح الرجل ولده الصغار. لقوله تعالى: "واللائي لم يحضن"، فجعل عدتها ثلاثة أشهر قبل البلوغ. حدثنا محمد بن يوسف حدثنا سفيان عن هشام عن أبيه عن عائشة رضي الله عنها: أن النبي صلى الله عليه وسلم تزوجها وهي بنت ست سنين، وأدخلت عليه وهي بنت تسع، ومكثت عنده تسعا. قال الحافظ ابن حجر رحمه الله في الفتح: قوله: لقول الله تعالى: "واللائي لم يحضن"، فجعل عدتها ثلاثة أشهر قبل البلوغ، أي فدل على أن نكاحها قبل البلوغ جائز، وهو استنباط حسن، لكن ليس في الآية تخصيص ذلك بالوالد ولا بالبكر".
ونقل عضو هيئة كبار العلماء قول ابن بطال في شرحه لصحيح البخاري في صفحة 172 - 173 على باب تزويج الصغار من الكبار: أجمع العلماء على أنه يجوز للآباء تزويج الصغار من بناتهم وإن كن في المهد؛ إلا أنه لا يجوز لأزواجهن البناء بهن إلا إذا صلحن للوطء، واحتملن الرجال، وأحوالهن تختلف في ذلك على قدر خلقهن وطاقتهن. وكانت عائشة رضي الله عنها حين تزوج بها النبي بنت ست سنين وبنى بها بنت تسع.
ونقل الفوزان قول مفتي السعودية الراحل الشيخ عبد العزيز بن باز في مجموع فتاواه ومقالاته الجزء الرابع صفحة 126 لما بلغه أن بعض الدول الإسلامية تريد تحديد سن الزواج بأن لا يقل عمر الفتى عن ثمانية عشر عاما وعمر الفتاة عن ستة عشر عاما. قال: فلما كان ذلك يخالف ما شرعه الله جل وعلا أحببت التنبيه لبيان الحق. فالسن في الزواج لم يُقيد بحد معين لا في البكر ولا في الصغير. والكتاب والسنة يدلان على ذلك. لأن فيهما الحث على الزواج والترغيب فيه من دون تقييد بسن معينة.
وخلص إلى القول: إنه "يجب على هؤلاء الذين ينادون بتحديد سن الزواج أن يتقوا الله ولا يخالفوا شرعه، أو يشرعوا شيئا لم يأذن به الله، فالحكم لله عز وجل، والتشريع حق له سبحانه لا يشاركه فيه غيره. ومن ذلك أحكام الزواج".

(And for such of your women as despair of menstruation) because of old age, (if ye doubt) about their waiting period, (their period (of waiting) shall be three months) upon which another man asked: “O Messenger of Allah! What about the waiting period of those who do not have menstruation because they are too young?” (along with those who have it not) because of young age, their waiting period is three months. Another man asked: “what is the waiting period for those women who are pregnant?” (And for those with child) i.e. those who are pregnant, (their period) their waiting period (shall be till they bring forth their burden) their child. (And whosoever keepeth his duty to Allah) and whoever fears Allah regarding what he commands him, (He maketh his course easy for him) He makes his matter easy; and it is also said this means: He will help him to worship Him well.

And what is the waiting period of the pregnant woman?’ And so Allah, exalted is He, revealed this verse”. Abu Ishaq al-Muqri’ informed us> Muhammad ibn ‘Abd Allah ibn Hamdun> Makki ibn ‘Abdan> Abu’l-Azhar> Asbat ibn Muhammad> Mutarrif> Abu ‘Uthman ‘Amr ibn Salim who said: “When the waiting period for divorced and widowed women was mentioned in Surah al-Baqarah, Ubayy ibn Ka‘b said: ‘O Messenger of Allah, some women of Medina are saying: there are other women who have not been mentioned!’ He asked him: ‘And who are they?’ He said: ‘Those who are too young [such that they have not started menstruating yet], those who are too old [whose menstruation has stopped] and those who are pregnant’. And so this verse (And for such of your women as despair of menstruation…) was revealed”.

Hukumnya boleh (mubah) secara syar'i dan sah seorang laki-laki dewasa menikahi anak perempuan yang masih kecil (belum haid). Dalil kebolehannya adalah Al-Qur`an dan As-Sunnah. Dalil Al-Qur`an adalah firman Allah SWT (artinya) :
"Dan perempuan-perempuan yang tidak haid lagi (menopause) di antara perempuan-perempuanmu jika kamu ragu-ragu (tentang masa iddahnya) maka iddah mereka adalah tiga bulan; dan begitu (pula) perempuan-perempuan yang tidak haid." (QS Ath-Thalaq [65] : 4).
Ibnu Katsir dalam kitab tafsirnya menyatakan bahwa yang dimaksud "perempuan-perempuan yang tidak haid" (lam yahidhna), adalah anak-anak perempuan kecil yang belum mencapai usia haid (ash-shighaar al-la`iy lam yablughna sinna al-haidh). Ini sesuai dengan sababun nuzul ayat tersebut, ketika sebagian shahahat bertanya kepada Nabi SAW mengenai masa iddah untuk 3 (tiga) kelompok perempuan, yaitu : perempuan yang sudah menopause (kibaar), perempuan yang masih kecil (shighar), dan perempuan yang hamil (uulatul ahmaal). Jadi, ayat di atas secara manthuq (makna eksplisit) menunjukkan masa iddah bagi anak perempuan kecil yang belum haid dalam cerai hidup, yaitu selama tiga bulan.
Imam Suyuthi dalam kitabnya Al-Iklil fi Istinbath At-Tanzil hal. 212 mengutip Ibnul Arabi, yang mengatakan,"Diambil pengertian dari ayat itu, bahwa seorang [wali] boleh menikahkan anak-anak perempuannya yang masih kecil, sebab iddah adalah cabang daripada nikah."
Jadi, secara tidak langsung, ayat di atas menunjukkan bolehnya menikahi anak perempuan yang masih kecil yang belum haid. Penunjukan makna (dalalah) yang demikian ini dalam ushul fiqih disebut dengan istilah dalalah iqtidha`, yaitu pengambilan makna yang mau tak mau harus ada atau merupakan keharusan (iqtidha`) dari makna manthuq (eksplisit), agar makna manthuq tadi bernilai benar, baik benar secara syar'i (dalam tinjauan hukum) maupun secara akli (dalam tinjauan akal). Jadi, ketika Allah SWT mengatur masa iddah untuk anak perempuan yang belum haid, berarti secara tidak langsung Allah SWT telah membolehkan menikahi anak perempuan yang belum haid itu, meski kebolehan ini memang tidak disebut secara manthuq (eksplisit) dalam ayat di atas.
Adapun dalil As-Sunnah, adalah hadits dari 'Aisyah RA, dia berkata :
"Bahwa Nabi SAW telah menikahi 'A`isyah RA sedang 'A`isyah berumur 6 tahun, dan berumah tangga dengannya pada saat 'Aisyah berumur 9 tahun, dan 'Aisyah tinggal bersama Nabi SAW selama 9 tahun." (HR Bukhari, hadits no 4738, Maktabah Syamilah). Dalam riwayat lain disebutkan : Nabi SAW menikahi 'A`isyah RA ketika 'Aisyah berumur 7 tahun [bukan 6 tahun] dan Nabi SAW berumah tangga dengan 'Aisyah ketika 'Aisyah umurnya 9 tahun. (HR Muslim, hadits no 2549, Maktabah Syamilah).
Imam Syaukani dalam kitabnya Nailul Authar (9/480) menyimpulkan dari hadits di atas, bahwa boleh hukumnya seorang ayah menikahkan anak perempuannya yang belum baligh (yajuuzu lil abb an yuzawwija ibnatahu qabla al-buluugh).
Berdasarkan dalil-dalil di atas, jelaslah bahwa mubah hukumnya seorang laki-laki menikah dengan anak perempuan kecil yang belum haid. Hukum nikahnya sah dan tidak haram. Namun syara' hanya menjadikan hukumnya sebatas mubah (boleh), tidak menjadikannya sebagai sesuatu anjuran atau keutamaan (sunnah/mandub), apalagi sesuatu keharusan (wajib). Wallahu a'lam.[rofx/klfh]

Notorious pro-Taliban Islamist clergy in Bangladesh, Mufti Fazlul Haque Amini has threatened to wage jihad in the country if the government will pass any law banning child marriage.
He said, two hundred thousand Jihadists of his group are ready to 'sacrifice' lives if any such law, which goes against "Koran and Sunnah" will be passed by the current government in the country.
Mufti Amini said, "Banning child marriage will cause challenging the marriage of the holy prophet of Islam, who also married minor Ayesha, when she was just eight years old".
He said, "The new law initiated by the current government will put the moral character of the prophet into controversy and challenge."
Fazlul Haque Amini further said, "Islam permits child marriage and it will not be tolerated if any ruler will ever try to touch this issue in the name of giving more rights to women."
It may be mentioned here that, current government in Bangladesh has taken several measures in ensuring better rights to the women thus treating child marriage as severe offense. It also recommends equal distribution of properties amongst male and female inherits. In contrary, Islamic Sharia law gives lesser rights to women as far as inheritance is concerned. It also allows men to marry any infant girl child. It may be mentioned here that, such law is prevalent in most of the Islamic republics, while in Iran, even forceful sexual relations with the married infant is allowed. A large segment of Muslim scholars and secularist individuals term this as mere perversion.
In Bangladesh, especially in the rural areas, child marriage is very regular phenomenon, where hundreds of child mothers die due to lack of medical facilities as well as for pre-mature pregnancy. There are even cases of deaths of child wives being virtually raped by their husbands. Child marriage is prevalent in rural Bangladesh both amongst the Muslim and non-Muslim families.
Several weeks back, Islamist clergy Mufti Fazlul Haque Amini and Moulana Rezaul Karim launched a movement of 'combating anti-Islam actions' by the government in Bangladesh. Since then, hundreds and thousands of followers of these fanatic leaders are active in various forms of demonstrations around the country. It is also reported in media that, minor boys in the Koranic Madrassas were forced join most of the anti-government demonstrations of these leaders. According to unofficial statistics, there are roughly 9 million students attending various madrassas in Bangladesh.

7 Apabila ada seorang menjual anaknya yang perempuan sebagai budak, maka perempuan itu tidak boleh keluar seperti cara budak-budak lelaki keluar.
9 Jika tuannya itu menyediakannya bagi anaknya laki-laki, maka haruslah tuannya itu memperlakukannya seperti anak-anak perempuan berhak diperlakukan.

Tafsir Ibn 'Abbas,
{ وَٱللاَّئِي يَئِسْنَ مِنَ ٱلْمَحِيضِ مِن نِّسَآئِكُمْ إِنِ ٱرْتَبْتُمْ فَعِدَّتُهُنَّ ثَلاَثَةُ أَشْهُرٍ وَٱللاَّئِي لَمْ يَحِضْنَ وَأُوْلاَتُ ٱلأَحْمَالِ أَجَلُهُنَّ أَن يَضَعْنَ حَمْلَهُنَّ وَمَن يَتَّقِ ٱللَّهَ يَجْعَل لَّهُ مِنْ أَمْرِهِ يُسْراً }
(And for such of your women as despair of menstruation) because of old age, (if ye doubt) about their waiting period, (their period (of waiting) shall be three months) upon which another man asked: “O Messenger of Allah! What about the waiting period of those who do not have menstruation because they are too young?” (along with those who have it not) because of young age, their waiting period is three months. Another man asked: “what is the waiting period for those women who are pregnant?” (And for those with child) i.e. those who are pregnant, (their period) their waiting period (shall be till they bring forth their burden) their child. (And whosoever keepeth his duty to Allah) and whoever fears Allah regarding what he commands him, (He maketh his course easy for him) He makes his matter easy; and it is also said this means: He will help him to worship Him well.

* تفسير Asbab Al-Nuzul by Al-Wahidi
{ وَٱللاَّئِي يَئِسْنَ مِنَ ٱلْمَحِيضِ مِن نِّسَآئِكُمْ إِنِ ٱرْتَبْتُمْ فَعِدَّتُهُنَّ ثَلاَثَةُ أَشْهُرٍ وَٱللاَّئِي لَمْ يَحِضْنَ وَأُوْلاَتُ ٱلأَحْمَالِ أَجَلُهُنَّ أَن يَضَعْنَ حَمْلَهُنَّ وَمَن يَتَّقِ ٱللَّهَ يَجْعَل لَّهُ مِنْ أَمْرِهِ يُسْراً }
(And for such of your women as despair of menstruation…) [65:4]. Said Muqatil: “When the verse (Women who are divorced shall wait, keeping themselves apart…), Kallad ibn al-Nu‘man ibn Qays al-Ansari said: ‘O Messenger of Allah, what is the waiting period of the woman who does not menstruate and the woman who has not menstruated yet? And what is the waiting period of the pregnant woman?’ And so Allah, exalted is He, revealed this verse”. Abu Ishaq al-Muqri’ informed us> Muhammad ibn ‘Abd Allah ibn Hamdun> Makki ibn ‘Abdan> Abu’l-Azhar> Asbat ibn Muhammad> Mutarrif> Abu ‘Uthman ‘Amr ibn Salim who said: “When the waiting period for divorced and widowed women was mentioned in Surah al-Baqarah, Ubayy ibn Ka‘b said: ‘O Messenger of Allah, some women of Medina are saying: there are other women who have not been mentioned!’ He asked him: ‘And who are they?’ He said: ‘Those who are too young [such that they have not started menstruating yet], those who are too old [whose menstruation has stopped] and those who are pregnant’. And so this verse (And for such of your women as despair of menstruation…) was revealed”.
